Please take notice that the Court, First Division, issued a Resolution datedJuly 8, 2019which reads as follows:
"G.R. No. 243063 (Philip Crespo y Gutierrez v. People of the Philippines). — After review, the Court resolves to DENY the petition for failure of petitioner to show any reversible error in the assailed ruling. Both the Regional Trial Court and the Court of Appeals (CA) found that petitioner is guilty of illegal sale of dangerous drugs penalized under Section 5, Article II of Republic Act (RA) No. 9165 or the Comprehensive Dangerous Drugs Act of 2002. They also held that the prosecution was able to establish compliance with Section 21 of RA No. 9165. Absent any clear showing of abuse, arbitrariness, or capriciousness committed by the lower court, its findings of facts, especially when affirmed by the CA, as in this case, are accorded respect if not finality and are considered binding on this Court.
WHEREFORE, premises considered, the Decision dated October 31, 2018 of the Court of Appeals in CA-G.R. CR-H.C. No. 09411, finding petitioner Philip Crespo y Gutierrez GUILTY beyond reasonable doubt of violation of Section 5, Article II of R.A. No. 9165, and sentencing him to suffer the penalty of life imprisonment and to pay a fine of P500,000.00 are hereby AFFIRMED. HTcADC
The letter dated April 29, 2019 of Ms. Jane G. Sabido, Chief, Archives Section, Judicial Records Division, Court of Appeals, Manila, addressed to the Judicial Records Office, this Court, in compliance with the Resolution dated March 4, 2019, transmitting the rollo of CA G.R. CR HC No. 09411 with 211 pages, one (1) folder of original records with sealed white envelope containing 2 pieces of P1,000.00 bill, and one (1) folder of transcript of stenographic notes is NOTED.
