FIRST DIVISION
[G.R. No. 243045. February 20, 2019.]
ALEXANDER D. CORCINO, petitioner,vs. AMELIA B. VALENCIA AND MARINA L. VALENCIA, respondents.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated February 20, 2019 which reads as follows:
"G.R. No. 243045 — (Alexander D. Corcino v. Amelia B. Valencia and Marina L. Valencia) — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
After review of the records, the Court resolves to DENY the petition for failure of the petitioner to sufficiently show that the Court of Appeals (CA) committed any reversible error in its February 14, 2018 Decision 1 and October 30, 2018 Resolution, 2 as to warrant the exercise of the Court's appellate jurisdiction.
As correctly ruled by the CA, there were no other administrative cases pending before any disciplinary authority at the time of the filing of the case with the People's Law Enforcement Board (PLEB). To note, respondents Amelia B. Valencia and Marina L. Valencia even informed the PLEB of the earlier filing of a complaint with the Directorate for Investigation and Detective Management and there was no showing of bad faith or deliberate intention to mislead the courts, the very evil which the prohibition against forum shopping seeks to prevent.
WHEREFORE, the petition is DENIED. The Decision dated February 14, 2018, and Resolution dated October 30, 2018, of the Court of Appeals in CA-G.R. SP No. 135739 are AFFIRMED.
SO ORDERED."
Very truly yours,
(SGD.) LIBRADA C. BUENADivision Clerk of Court
