NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 14 June 2021 which reads as follows:
"OCA IPI No. 20-5016-RTJ (Commodity Quest, Inc., represented by Rodolfo Martin M. Panganiban v. Hon. Genie G. Gapas-Agbada, Presiding Judge, Branch 42, Regional Trial Court, Virac, Catanduanes). — The Court NOTES the: (1) complaint-affidavit 1 dated December 6, 2019 of complainant Commodity Quest, Inc., represented by Mr. Rodolfo Martin M. Panganiban (complainant), charging respondent Presiding Judge Genie G. Gapas-Agbada (respondent Judge) of the Regional Trial Court (RTC), Branch 42, Virac, Catanduanes, in her former capacity as Acting Presiding Judge, RTC, Br. 264, Pasig City, with gross ignorance of the law, knowingly rendering an unjust judgment and grave misconduct relative to Crim. Case Nos. 15984 and 15985 both entitled 'People of the Philippines vs. Maria Claudia Belinda Lim' for Qualified Theft; (2) Comment 2 dated March 13, 2020 of respondent Judge; and (3) Reply 3 dated June 30, 2020 of complainant.
The Court RESOLVES to ADOPT and APPROVE the findings of fact, conclusions of law, and recommendation of the Office of the Court Administrator in the attached Report 4 dated January 27, 2021. Accordingly, the administrative complaint against respondent Presiding Judge Genie G. Gapas-Agbada of Regional Trial Court of Virac, Catanduanes, Branch 42, in her former capacity as Acting Presiding Judge of Regional Trial Court of Pasig City, Branch 264, is hereby DISMISSED for raising issues which are judicial in nature.
