Please take notice that the Court, First Division, issued a Resolution datedDecember 3, 2018which reads as follows:
"G.R. No. 242174 — Coastal Highpoint Ventures, Incorporated, Petitioner, v. Miguela Dignos, Respondent.
Considering the allegations, issues, and arguments adduced in the Petition for Review on Certiorari of the May 25, 2018 Decision and the September 20, 2018 Resolution of the Court of Appeals (CA) in CA-G.R. SP No. 08669, the Court resolves to DENY the Petition for (i) being factual in nature; and (ii) failure to show any reversible error committed by the CA in issuing the assailed Decision and Resolution as to warrant the exercise of this Court's discretionary appellate jurisdiction.
The CA was correct in finding that petitioner merely employed circuitous means in asserting its position that the injunction it sought was not against a final and executory decision of this Court. But a review of the petition reveals that it was essentially asking to enjoin the enforcement of this Court's ruling in G.R. No. 201564, which had long become final and executory. HEITAD
As for petitioner's claim of respondent Miguela Dignos' failure to comply with conditions precedent required to implement an Order of Award of the Department of Environment and Natural Resources (DENR), it failed to submit any substantial basis for said claim except for its own self-serving allegations. Moreover, this is a factual issue the determination of which belongs to the DENR as the administrative agency tasked to implement the execution of the DENR-Region VII's September 28, 2006 Order.
ACCORDINGLY, the Court resolves to AFFIRM the May 25, 2018 Decision and the September 20, 2018 Resolution of the Court of Appeals in CA-G.R. SP No. 08669.
The Department of Environment and Natural Resources, Region VII, through Hon. Isabelo R. Montejo, in his capacity as the Regional Executive Director, DENR-Community Environment and Natural Resources Office, Luyang, Carmen, Cebu, through Hon. Roldan R. Cotejo, in his capacity as OIC, CENR Officer, are dropped as respondents in this case. aDSIHc
