Please take notice that the Court, First Division, issued a Resolution datedFebruary 15, 2022which reads as follows:
"G.R. Nos. 250683 and 250740-42 (Roger Cabales Chio v. Sandiganbayan, Fifth (5th) Division and the People of the Republic of the Philippines). — This is a Petition for Certiorari1 under Rule 65 of the Revised Rules of Court seeking the annulment of Resolution 2 dated July 29, 2019 and Resolution 3 dated September 17, 2019, both rendered by the Sandiganbayan in Criminal Case Nos. SB-19-CRM-0053 to 0056, which denied the Motion to Dismiss/To Quash Information 4 which was filed by petitioner Roger Cabales Chio on July 16, 2019. SDHacT
On September 7, 2020, this Court received a Manifestation 5 dated September 2, 2020 from the counsel of petitioner stating therein that Roger Cabales Chio died on August 11, 2020. His counsel later submitted before this Court, a copy of petitioner's Certificate of Death 6 dated August 13, 2020. It would thus appear that petitioner passed away during the pendency of his petition. Inevitably, petitioner's death rendered his petition before this Court, moot and academic as there is no longer any justiciable controversy, whose resolution would be of practical value and use. 7
WHEREFORE, the Court resolves to DISMISS the petition for being moot and academic.
