NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJune 19, 2019which reads as follows:
"G.R. No. 240007 (BERSAMIN CATAMORA y DE LOS SANTOS, Petitioner, v. PEOPLE OF THE PHILIPPINES, Respondent.) — Acting on the petitioner's motion for reconsideration of the resolution promulgated on November 7, 2018, the Court resolves to DENY the same as the basic issues raised therein have been passed upon by the Court and no substantial arguments were presented to warrant the reversal of the questioned resolution.
However, the Court modifies the penalty imposed by the Court of Appeals (CA) in Crim. Case No. 05-783. 1 The penalty of imprisonment is modified to a straight period of four (4) months of arresto mayor. The penalty of payment of a fine of P100,000.00 and to undergo psychological counseling shall remain.
WHEREFORE, the Court resolves to DENY the Motion for Reconsideration and AFFIRMS WITH MODIFICATION the March 2, 2018 decision of the Court of Appeals in CA-G.R. CR No. 39724. In Crim. Case No. 05-783, apart from the payment of the fine of P100,000.00 and to undergo psychological counselling, the petitioner is sentenced to suffer the penalty of imprisonment of four (4) months of arresto mayor.
