NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated03 January 2022which reads as follows: HTcADC
"UDK-17008 (Eliseo Carreon v. Thelma Melendez). — After a judicious study of the case, the Court resolves to DENY the Petition for Review on Certiorari1 filed by Eliseo Carreon (petitioner) for failure to sufficiently show that the Court of Appeals committed any reversible error in its Decision 2 dated September 15, 2020 and Resolution 3 dated January 26, 2021 which affirmed with modification the Decision 4 dated October 17, 2016 of the Regional Trial Court of Iloilo City, Branch 22, finding petitioner liable for damages suffered by Thelma Melendez (respondent).
Nonetheless, in view of the Court's ruling in Nacar v. Gallery Frames, 5 the Court imposes a legal interest of six percent (6%) per annum on all the monetary awards granted in favor of respondent, computed from the finality of judgment until its full satisfaction.
WHEREFORE, the findings of fact and conclusions of law of the Court of Appeals are ADOPTED. The assailed Decision dated September 15, 2020 and Resolution dated January 26, 2021 of the Court of Appeals in CA-G.R. CV No. 06385 are AFFIRMED with MODIFICATION. Accordingly, petitioner Eliseo Carreon is ordered to pay respondent Thelma Melendez the amount of P150,000.00 as moral damages and P10,000.00 as compensatory damages. He is further ordered to pay interest on all damages awarded at the legal rate of six percent (6%) per annum from the date of finality of this Resolution until fully paid.
