Please take notice that the Court, Second Division, issued a Resolution datedAugust 15, 2022 which reads as follows:
"UDK-17523 (Brisk Spring Purified Drinking Water and Dona Galola vs. The Honorable Court of Appeals, Former Twenty-First Division, Cagayan De Oro City, Manuel Galola, Beverly Galola, and Claudio Maturan). — This Court resolves a Petition for Certiorari assailing the Court of Appeals' (CA) Resolutions dated April 28, 2021 1 and October 12, 2021 2 in CA-G.R. SP No. 10235-MIN. AaCTcI
After a judicious study of the case, the Court resolves to DISMISS the petition for failure to sufficiently show that the CA committed grave abuse of discretion amounting to excess or lack of jurisdiction. However, the Court deems it proper to modify the Court of Appeals' resolutions such that the amounts awarded to the respondents shall earn interest at the rate of six percent (6%) per annum until full payment. 3
FOR THESE REASONS, the Petition is DISMISSED. The Court of Appeals' Resolutions dated April 28, 2021 and October 12, 2021 in CA-G.R. SP No. 10235-MIN are AFFIRMED with MODIFICATION in that the amounts awarded shall earn interest at the rate of six percent 6% per annum until full payment.
