NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJuly 3, 2019which reads as follows:
"G.R. No. 241137 (Lorna Briones-Bhandari v. People of the Philippines). — The motion for extension of time to file petition for review on certiorari filed by petitioner is GRANTED.
After review, the Court resolves to DENY the petition since the Decision subject thereof is already final and executory. In any case, petitioner failed to show that the Court of Appeals committed reversible error in upholding the findings of the Regional Trial Court. Nonetheless, in view of the enactment of Republic Act No. 10951, 1 We deem it proper to modify the penalty imposed upon petitioner.
WHEREFORE, the petition is DENIED. The Decision dated February 20, 2017 and Resolution dated July 19, 2018 of the Court of Appeals in CA-G.R. CR No. 37496 finding petitioner GUILTY of estafa under Section 315 (1) (b) of the Revised Penal Code are AFFIRMED with the MODIFICATION that petitioner is sentenced to suffer imprisonment for four (4) years and two (2) months of prision correccional, as minimum to eight (8) years of prision mayor, as maximum. The amount of P5,000,000.00, which petitioner and Bambi Bhandari are ordered to return to Genoveva Tan, is subject to a legal interest of 6% from the finality of this resolution until full satisfaction.
