MARIA CELGA R. BRILLANTES, petitioner,vs. HEIRS OF FERNANDA AND ELIAS BELINARIO, NAMELY: LOURDES BELINARIO-CRISPINO, JUANITA TE AND LUCIA RAGANAS, respondents.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedJanuary 10, 2019which reads as follows:
"G.R. No. 242438 (Maria Celga R. Brillantes v. Heirs of Fernanda and Elias Belinario, namely: Lourdes Belinario-Crispino, Juanita Te and Lucia Raganas). — The urgent omnibus motion: 1. to enter appearance; and 2. request for extension of time to file petition for review on certiorari under Rule 45 of the Rules of Court filed by petitioner Maria Celga R. Brillantes is GRANTED.
After review, the Court resolves to DENY the petition for being filed out of time. Petitioner had until October 29, 2018 to file her petition. However, the Court received her petition only on November 6, 2018. Petitioner's failure to timely file her petition in accordance with Section 2, Rule 45 of the Rules of Court is sufficient ground to deny it. Consequently, it has also precluded this Court from ruling on the case.
WHEREFORE, the petition is DENIED. The March 16, 2018 and September 4, 2018 Resolutions of the Court of Appeals in CA-G.R. SP No. 08454-MIN are AFFIRMED.
SO ORDERED."
Very truly yours,
(SGD.) LIBRADA C. BUENADivision Clerk of Court
