Please take notice that the Court, First Division, issued a Resolution datedJune 4, 2018which reads as follows:
"G.R. No. 235839 (Miguel Borromeo y Alvar v. People of the Philippines). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
After review of the records, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision. It is a settled rule that a number of circumstantial evidence may be so credible to establish a fact from which it may be inferred, beyond reasonable doubt, that the elements of a crime exist and that the accused is its perpetrator. There is no requirement in our jurisdiction that only direct evidence may convict. After all, evidence is always a matter of reasonable inference from any fact that may be proven by the prosecution, provided the inference is logical and beyond reasonable doubt. 1 Anent the other issues raised in the petition, this Court has consistently adhered to the principle that only questions of law, distinctly set forth, may be raised in a petition for review on certiorari of a decision of the Court of Appeals, as the Supreme Court is not a trier of facts. The appellate jurisdiction of the Supreme Court is limited to reviewing errors of law, accepting as conclusive the factual findings of the lower court upon its own assessment of the evidence. aScITE
WHEREFORE, premises considered, the petition is DENIED. The assailed Decision dated June 29, 2017 and Resolution dated November 2, 2017 denying the motion for reconsideration issued by the Court of Appeals in CA-G.R. CR No. 38791 are hereby AFFIRMED.
