NOTICE

Please take notice that the Court, First Division, issued a Resolution datedJuly 11, 2018which reads as follows:
"G.R. No. 238478 (Rufino Besmonte Boral v. People of the Philippines). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
After review, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed reversible error in upholding the conviction of petitioner Rufino Besmonte Boral for illegal possession of firearm punishable under Section 28 (a) of Republic Act No. 10591.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law of the Court of Appeals, as reflected in its December 15, 2017 Decision in CA-G.R. CR No. 39323. Petitioner Rufino Besmonte Boral is found GUILTY beyond reasonable doubt of illegal possession of firearm punishable under Section 28 (a) of Republic Act No. 10591, and is sentenced to suffer the indeterminate penalty of six years and one day of prision mayor in its minimum period, as minimum, and eight years, eight months, and one day of prision mayor in its medium period, as maximum.
