NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated11 November 2020which reads as follows:
"G.R. No. 234787 (Jaime C. Bonifacio v. Edelwina F. Asuncion and Osanna O. Asuncion). — After a judicious review of the records herein, the Court resolves to DENY the petition for review for failure to show that the Court of Appeals committed reversible error in its October 26, 2016 Decision 1 and October 10, 2017 Resolution, 2 in CA-G.R. SP No. 143360, dismissing the petition for certiorari filed before it.
It is settled doctrine that only questions of law may be entertained by this Court in a petition for review on certiorari under Rule 45 of the Rules of Court. In here, petitioner raises factual matters which the Court is precluded from entertaining. Although there are exceptions to the rule, 3 petitioner failed to present sufficient justification that his case falls under any of these exceptions.
ACCORDINGLY, the Court DENIES the petition; AFFIRMS the October 26, 2016 Decision and October 10, 2017 Resolution of the Court of Appeals in CA-G.R. SP No. 143360; and ORDERS petitioner TO PAY costs of suit.
