NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated March 6, 2019which reads as follows:
"G.R. No. 244337 (Guerin C. Bondoc, Rufina Ngini, Janice Paras, Benigno T. Pauco, John Patrick S. Damiles, Romeo M. Gallinera, Mary Fredda T. Caleja, and Arlene O. Haltland v. Marissa Capulong Dorado, Elenita B. Panganiban a.k.a. Helen Panganiban and Mario V. Hilario)
After review of the records, the Court resolves to DENY the petition for: (i) failure to submit a verified declaration that the pleading and annexes submitted electronically are complete and true copies of the printed document and annexes filed with the Supreme Court, pursuant to A.M. Nos. 10-3-7-SC and 11-9-4-SC; (ii) failure to attach the affidavit of service of copy of the petition on the adverse party and on the lower courts as required by Sections 3 and 5 of Rule 45, Section 5 of Rule 56, and Section 13 of Rule 13 of the Rules of Court; and (iii) failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in its January 17, 2019 Resolution, 1 as to warrant the exercise of the Court's appellate jurisdiction.
As correctly ruled by the CA, the decision of the Housing and Land Use Regulatory Board had already attained finality because petitioners failed to appeal before the CA within the fifteen (15)-day reglementary period. Petitioners should have appealed to the CA via Rule 43 of the Rules of Court as required under Section 20 of Republic Act No. 9904, and not to the Office of the President.
WHEREFORE, the petition is DENIED. The January 17, 2019 Resolution of the Court of Appeals in CA-G.R. SP No. 157857 is AFFIRMED.
The petitioners are hereby required to SUBMIT within five (5) days from notice hereof, a soft copy in compact disc, USB or e-mail containing the PDF file of the signed joint petition for review on certiorari with application for temporary restraining order pursuant to A.M. Nos. 10-3-7-SC and 11-9-4-SC. CAIHTE
