Please take notice that the Court, First Division, issued a Resolution dated June 20, 2018which reads as follows: HESIcT
"G.R. No. 237573 (Rowelyn Bolinas v. People of the Philippines). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
After review of the records, we resolve to DENY the petition for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in its Decision dated March 28, 2017 and Resolution dated January 29, 2018.
We agree with the CA in upholding the Decision of the Regional Trial Court finding petitioner GUILTY of child abuse under Republic Act (RA) No. 7610. It is a general policy of this Court not to disturb the findings of the courts especially where the findings of both the trial court and the CA completely coincide. More specifically in criminal cases where factual findings of the trial court are generally accorded great weight and respect on appeal, especially when such findings are supported by substantial evidence on record, 1 as in this case.
WHEREFORE, the petition is DENIED. The Decision dated March 28, 2017 and Resolution dated January 29, 2018 of the Court of Appeals in CA-G.R. CR No. 02436 finding petitioner Rowelyn Bolinas GUILTY BEYOND REASONABLE DOUBT of child abuse under RA No. 7610 and meting her the indeterminate penalty of four (4) years, nine (9) months, and eleven (11) days of prision correccional, as minimum, to seven (7) years, four (4) months, and one (1) day of prision mayor, as maximum, are hereby AFFIRMED.
