Please take notice that the Court, First Division, issued a Resolution dated January 19, 2021which reads as follows:

BLESILDA CONCEPCION, MICHAEL TAN, TEODORO LOCSIN, THOMAS SMITH, JR., MARTIN ERIC ROBINSON, REV. FR. ROBERTO YAP, JR., DR. MEDIADORA SANIEL, RAFAEL REYES, DR. EUGENIO JOSE RAMOS, ALBERTO BUENVIAJE, MA. EDITA ANGELA ELICAÑO, SIS. MARIA ROSALIA NACIONALES, RVM (Member, Board of Director), ATTY. MARTIN SAMSON (VP Legal Services Department), and JOSEPH CARBALLO (Manager, Audit Department),respondents.
After a judicious review of the Petition and its annexes, the Court finds that the Petition lacks merit as it failed to show that the Court of Appeals (CA) committed any reversible error in denying the petition for certiorari.
The CA was correct when it found that petitioner was not constructively dismissed and that she failed to present evidence to support her allegations. The findings of the CA, which affirmed the National Labor Relations Commission, both of which are supported by substantial evidence, are binding on the Court.
WHEREFORE, premises considered, the Court resolves to DENY the Petition and AFFIRM the Decision 1 dated December 6, 2019 and Resolution 2 dated August 25, 2020 of the Court of Appeals in CA-G.R. SP No. 160669.
The National Labor Relations Commission is DROPPED as party respondent in this case, pursuant to Sec. 4 (a), Rule 45 of the 2019 Amendments to the 1997 Rules of Civil Procedure (A.M. No. 19-10-20-SC).
