Please take notice that the Court, First Division, issued a Resolution datedFebruary 5, 2018which reads as follows: HTcADC
"G.R. No. 234853 (Justo Abarra Bergonia v. Sergio F. Oreas). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
The Court resolves to DENY the petition and AFFIRM the Court of Appeals (CA) Resolutions dated May 25, 2017 and October 6, 2017 in CA-G.R. SP No. 150794. The Ombudsman Decision dated March 10, 2017 had already attained finality in view of petitioner Justo Abarra Bergonia's failure to file a petition for review under Rule 43 of the Rules of Court or a motion for extension in filing the same within the 15-day reglementary period.
Moreover, the remedy of review before this Court had already been lost. The CA Resolution dated May 25, 2017 had already attained finality in view of petitioner's failure to file a motion for reconsideration within the non-extendible 15-day reglementary period to file the same.
