Please take notice that the Court, First Division, issued a Resolution datedApril 23, 2018which reads as follows: ISHCcT
"G.R. No. 233136 (Nilo Ramon Bacay y Sioson v. People of the Philippines). — After review of the records, the Court resolves to DENY the petition and AFFIRM the Court of Appeals (CA) for failure to sufficiently show that the CA committed any reversible error in upholding the conviction of petitioner Nilo Ramon Bacay y Sioson for violation of Sections 5 and 11, Article II of Republic Act No. 9165, otherwise known as the "Comprehensive Dangerous Drugs Act of 2002."
The issues raised by petitioner have already been squarely passed upon by the CA in the assailed Decision and Resolution. As correctly ruled by the CA, the elements of the offenses were duly established through the testimonies of the apprehending police officers, who are presumed to have performed their duties in a regular manner, and the integrity and evidentiary value of the items seized from petitioner were properly preserved from the time of the arrest until they were presented as evidence before the trial court.
The Court sees no reason to disturb the factual findings of both the trial court and the CA.
WHEREFORE, the petition is DENIED. The Decision dated March 7, 2017 and Resolution dated June 30, 2017 of the Court of Appeals in CA-G.R. CR-H.C. No. 08177 are hereby AFFIRMED.
The petitioner's manifestation and compliance with the Resolution dated September 4, 2017, submitting the compact disc containing the soft copy of the motion for extension to file petition for review on certiorari, is NOTED.
