Please take notice that the Court, First Division, issued a Resolution datedJune 10, 2019which reads as follows:
"G.R. No. 244556 (Leonila M. Bacalso v. Samson Kho). — The motion for extension of time to file appeal by certiorari filed by petitioner is GRANTED.
After review, the Court resolves to DENY the petition for failure of petitioner to show any reversible error in the assailed ruling. The Court of Appeals (CA) correctly affirmed the Regional Trial Court and the Metropolitan Trial Court's finding that petitioner is civilly liable for the face value of the check plus legal interest from the filing of the information and the cost of suit. The courts a quo uniformly held that petitioner has not yet fully paid her obligation with James Renn So. As the issuer of the check, petitioner is ultimately liable for its full value. Absent any clear showing of abuse, arbitrariness, or capriciousness committed by the lower court, its findings of facts, especially when affirmed by the CA, as in this case, are accorded respect if not finality and are considered binding on this Court.
WHEREFORE, premises considered, the petition is DENIED. The Decision dated February 15, 2018 and Resolution dated January 24, 2019 of the Court of Appeals in CA-G.R. SP No. 139304 are hereby AFFIRMED.
