Please take notice that the Court, First Division, issued a Resolution datedJune 19, 2019which reads as follows:
"G.R. No. 244618 (Jonathan L. Auguis v. Sogo Drive Inn, Inc. and Jose Patricio Magallanes). — After a judicious perusal of the case, the Court resolves to DENY the instant petition and AFFIRM the Decision dated March 19, 2018 and Resolution dated October 18, 2018 of the Court of Appeals (CA) in CA-G.R. SP No. 151544 for failure of petitioner to sufficiently show that the CA committed any reversible error in finding no grave abuse of discretion in the National Labor Relations Commission's (NLRC) Decision dated March 21, 2017 and Resolution dated April 24, 2017 finding petitioner's dismissal valid.
The CA correctly upheld the NLRC's findings that respondent validly terminated petitioner on the grounds of serious misconduct and loss of trust and confidence found under Article 297 (formerly Article 282) of the Labor Code.
WHEREFORE, premises considered, the Decision dated March 19, 2018 and Resolution dated October 18, 2018 of the Court of Appeals in CA-G.R. SP No. 151544 are hereby AFFIRMED.
The petitioner's manifestation stating that the petition for review on certiorari was filed through registered mail on February 28, 2019, and that the post office did not receive petitioner's payment for filing due to absence of post money order, is NOTED.
