Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedFebruary 18, 2019which reads as follows:
"G.R. No. 243051 — Antonio S. Arcenal, Petitioner, v. C.F. Sharp Crew Management, Inc. and Coral Marine Pte. Ltd., Respondents.
The Court resolves to GRANT petitioner's Motion for Extension seeking an additional period of 30 days from the expiration of the reglementary period within which to file his Petition for Review on Certiorari.
After carefully reviewing the allegations, arguments, and issues in the instant Amended Petition for Review on Certiorari, the Court resolves to DENY the same for failure of the petitioner to show that the Court of Appeals (CA) committed any reversible error in its assailed Decision dated April 16, 2018 and Resolution dated November 8, 2018 in CA-G.R. SP No. 151655 as to warrant the exercise of this Court's discretionary appellate jurisdiction. On the contrary, the CA's Decision and Resolution were in accord with the facts and applicable laws and jurisprudence.
The CA was correct when it held that the National Labor Relations Commission (NLRC) did not act with grave abuse of discretion in affirming the Labor Arbiter (LA). This Court finds no cogent reason to reverse the common findings of the LA, the NLRC, and the CA that petitioner's illness was not work-related and, therefore, not compensable. We accord not only respect, but even finality, to the factual findings and evaluation of evidence of the labor tribunals, especially when affirmed by the CA, as in this case.
ACCORDINGLY, the Court resolves to AFFIRM the April 16, 2018 Decision and November 8, 2018 Resolution of the Court of Appeals in CA-G.R. SP No. 151655.
The Court NOTES petitioner's Manifestation and GRANTS his Motion to Admit Amended Petition for Review on Certiorari dated January 18, 2019. The Court likewise NOTES petitioner's original Petition for Review on Certiorari and Manifestation.
