NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated October 5, 2022which reads as follows:
"G.R. No. 259323 (Angeline O. Araneta and Adelaido B. Araneta v. Lorelei T. Tana and Jobil B. Tana). — After a review of the records, the Court resolves to DENY the Petition for Review on Certiorari1 (petition) for failure of petitioners Angeline O. Araneta and Adeilado B. Araneta (petitioners) to sufficiently show that the Court of Appeals (CA) committed any reversible error in its Decision 2 dated 21 January 2021 and its Resolution 3 dated 28 February 2022 in CA-G.R. SP No. 162318.
As correctly ruled by the CA, petitioners are liable for P200,000.00, the principal loan extended by respondents Lorelei T. Tana and Jobil B. Tana. There being no provision of payment of interest indicated therein, the same is subject to six percent (6%) interest per annum from the date of extrajudicial demand or on 20 September 2017 until finality of judgment. In addition, the interest due on the principal amount accruing as of judicial demand shall likewise earn legal interest at the rate of 6% per annum from the date of judicial demand, until full payment, pursuant to Article 2212 of the Civil Code which states that "[i]nterest due shall earn legal interest from the time it is judicially demanded, although the obligation may be silent upon this point." 4
WHEREFORE, the petition is DENIED. The Decision dated 21 January 2021 and the Resolution dated 28 February 2022 of the Court of Appeals in CA-G.R. SP No. 162318 are AFFIRMED with MODIFICATION. Petitioners Angeline O. Araneta and Adelaido B. Araneta are ordered to pay respondents Lorelei T. Tana and Jobil B. Tana the principal amount of P200,000.00, plus six percent (6%) legal interest per annum from 20 September 2017 until full payment. Further, the interest due shall earn interest at the rate of six percent (6%) per annum from the date of judicial demand until full payment.
