Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedSeptember 14, 2021which reads as follows:
"G.R. No. 252786 — APTRANS represented by Alberto Paras v. Mary Jane T. Reyes, Sonny V. Reyes, Maria Paulino and Justin Reyes, represented by Maria Jane T. Reyes.
In petitions for review on certiorari under Rule 45 of the Rules of Court, the Court is narrowly confined to the review of legal issues. But here, the issues raised by petitioner APTRANS represented by Alberto Paras are factual in nature — did respondents Mary Jane T. Reyes, Sonny V. Reyes, Maria Paulino and Justin Reyes, represented by Maria Jane T. Reyes establish the negligence of APTRANS' driver by preponderance of evidence?; and how much should be awarded as damages? 1 Surely, these issues would require the Court to re-evaluate the evidence presented by the parties during trial, which is not allowed in Rule 45 petitions. Hence, even on this ground alone, the petition should be dismissed outright.
In any event, there is no cogent reason to alter or modify the factual findings of the trial court which are binding upon the Court, especially when the same carry the full concurrence of the Court of Appeals, as in this case.
We deem it necessary, however, to impose six percent (6%) interest per annum on the monetary awards from finality of this Resolution until full payment in accordance with Nacar v. Gallery Frames. 2
WHEREFORE, the petition is DENIED. The assailed Decision dated October 17, 2019 and Resolution dated June 30, 2020 in CA-G.R. CV No. 106464 are AFFIRMED with MODIFICATION, imposing six percent (6%) interest per annum on the total monetary awards from finality of this Resolution until fully paid.
