Please take notice that the Court, Third Division, issued a Resolution datedApril 8, 2019, which reads as follows:
"G.R. No. 243418 (WILFREDO ALCARAZ y DE LAZA, petitioner v. PEOPLE OF THE PHILIPPINES, respondent). — After considering the allegations, issues, and arguments adduced in the Petition for Review on Certiorari, 1 which assails the June 21, 2018 Decision 2 and November 26, 2018 Resolution 3 of the Court of Appeals in CA-G.R. CR No. 39997, this Court resolves to DENY the Petition for raising substantially factual issues and failing to show any reversible error in the assailed Decision as to warrant the exercise of this Court's discretionary appellate jurisdiction. We AFFIRM WITH MODIFICATION the June 21, 2018 Decision of the Court of Appeals: HTcADC
WHEREFORE, premises considered, the Decision dated 26 April 2017 of the Regional Trial Court, Branch 5, Tuguegarao City is AFFIRMED with MODIFICATION, as follows: Accused-appellant Wilfredo Alcaraz y De Laza is sentenced to suffer an indeterminate penalty of eight (8) years and one (1) day of prision mayor, minimum, as MAXIMUM, and two (2) years and four (4) months of prision correccional, minimum, as MINIMUM. He is also ordered to pay the victim Lester Tannagan the sums of: (1) Five Hundred Seventy-Three Thousand Two Hundred Sixty-Six Pesos and Nine Centavos (P573,266.09) as civil liability; (2) Thirty Thousand Pesos (P30,000.00) as moral damages; and (3) Thirty Thousand Pesos (P30,000.00) as civil indemnity. All monetary awards shall earn interest at the rate of six percent (6%) per annum reckoned from the finality of this Decision until fully paid.
In the service of his sentence, accused-appellant shall be credited with the period of his preventive detention.
