Please take notice that the Court, Second Division, issued a Resolution dated 25 March 2019 which reads as follows:
"G.R. No. 244083 (Air Materiel Wing Savings and Loan Association, Inc. [AMWSLAI], Joe A. Orallo, and Librado V. Abad v. The Honorable Monetary Board of the Bangko Sentral ng Pilipinas)
After a judicious study of the case, the Court resolves to DENY the instant petition 1 and AFFIRM the June 29, 2018 Decision 2 and the January 14, 2019 Resolution 3 of the Court of Appeals (CA) in CA-G.R. SP No. 146343 for failure of petitioner Air Materiel Wing Savings and Loan Association, Inc. (AMWSLAI) to sufficiently show that the CA committed any reversible error in ruling that the Regional Trial Court of Pasay City, Branch 119 (RTC) gravely abused its discretion when it granted AMWSLAI's petition for certiorari4 dated September 11, 2015 (Certiorari petition) and issued 5 the writ of preliminary injunction against public respondent Monetary Board of the Bangko Sentral ng Pilipinas (public respondent).
As correctly ruled by the CA, AMWSLAI should have filed an appeal before it under Rule 43 of the Rules of Court (Rules) — and not a petition for certiorari before the RTC under Rule 65 of the same Rules 6 — considering that the CA has appellate jurisdiction over resolutions of public respondent which are issued in the exercise of its quasi-judicial functions. 7 Accordingly, the RTC did not have jurisdiction to act on the above-mentioned certiorari petition, much more issue the ancillary writ of preliminary injunction against public respondent.
