This is a civil case filed by Jocelyn S. Acosta against Attys. Jose S. Alvarez, Jr., Roberto I. Acda, and Delfin Agcaoili, Jr. for violations of the Lawyer's Oath and the Code of Professional Responsibility. The case against Atty. Alvarez was dismissed due to lack of evidence showing his violation of the Lawyer's Oath and the Code of Professional Responsibility. Atty. Acda was suspended from the practice of law for six months, had his notarial commission immediately revoked, and was disqualified from being appointed as notary public for two years due to his deplorable laxity in the administration of his office. The complaint against Atty. Agcaoili was returned to the IBP for investigation as the Court found that the IBP had furnished him with processes at his former address instead of his current one.

NOTICE

Sirs/Mesdames :

Please take notice that the Court, First Division, issued a Resolution datedJuly 22, 2019which reads as follows:

"A.C. No. 8894 [Formerly CBD Case No. 12-3324] (Jocelyn S. Acosta v. Attys. Jose S. Alvarez, Jr., Roberto I. Acda, and Delfin Agcaoili, Jr.). — Considering that the findings of fact and recommendation of the Investigating Commissioner in the attached report and recommendation, as approved by the IBP Board of Governors, are supported by the evidence on record and applicable laws, the Court ADOPTS and ACCEPTS these findings and recommendation to: (i) DISMISS the case against Atty. Jose S. Alvarez, Jr., there being no showing that he violated the Lawyer's Oath and the Code of Professional Responsibility; and (ii) SUSPEND Atty. Roberto I. Acda from the practice of law for six (6) months, immediately revoke his notarial commission and DISQUALIFY him from being appointed as notary public for two (2) years for his deplorable laxity in the administration of his office. There being no motion for reconsideration or petition before the Court, the complaints against Attys. Alvarez and Acda are deemed CLOSED and TERMINATED.

It appearing from the records that the IBP had furnished Atty. Delfin R. Agcaoli, Jr. with processes at his former address at "No. 130 Dr. Alejos St., Laloma, Quezon City" despite Atty. Agcaoli's manifestation that his current address is "No. 13 Caimito St., Payatas, Quezon City," the Court reverts the complaint against him to the IBP for investigation, report and recommendation or resolution within ninety (90) days from notice.
