SECOND DIVISION
[G.R. No. 245838. June 19, 2019.]
ERIC A. ACEJO, petitioner, vs.DRA. CRISTINA BUENSUCESO, respondent.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated19 June 2019which reads as follows:
"G.R. No. 245838 — Eric A. Acejo vs. Dra. Cristina Buensuceso
The petition is denied for failure to sufficiently show that the Court of Appeals committed reversible error in issuing its Decision dated November 27, 2018 and Resolution dated February 26, 2019 as to merit this Court's exercise of its discretionary appellate jurisdiction.
The petition raises a pure factual issue: Did petitioner issue subject checks in payment of his obligation to Dr. Buensuceso? This Court's jurisdiction over cases brought before it via petition for review on certiorari is limited to the review and revision of errors of law which the Court of Appeals may have committed in rendering its decision or resolution in question. Where pure factual issues are invoked, as in this case, the Court will not take cognizance therefor, let alone analyze and weigh all over again the evidence already considered in the proceedings below not once, not twice but three times over. 1 The Court shall adhere to the rule absent any showing that the Court of Appeals here had misapprehended facts or disregarded evidence on record. HTcADC
WHEREFORE, the petition is DENIED and the Court of Appeal's Decision dated November 27, 2018 and Resolution dated February 26, 2019, AFFIRMED."
Very truly yours,
MARIA LOURDES C. PERFECTODivision Clerk of Court
