March 23, 1990 VAT RULING NO. 075-90 Indo Textile Mills, Inc. 403 Equitable Bank Bldg. Sen. Gil Puyat Ext. cor. Paseo de Roxas, Makati Metro Manila Attention: Mr . H . C . Sacheti President Gentlemen : This refers to your letter dated August 7, 1989 stating that as a VAT registered enterprise (VAT Registration No. 21-6-000251), you deliver spurn yarns to customers who are BOI-registered export producers operating customs bonded manufacturing warehouse; that pursuant to Section 2 of Revenue Regulations No. 2-88, your applications for zero rating of your sale to your customers were approved June 15, 1988 (i.e. after the issuance of RR 2-88). In connection therewith, you are requesting that your applications for zero-rating of each of your buyers be made to retroact to January 1, 1988 when Executive Order No. 273 took effect. In reply, please be informed that your request cannot be granted since under Section 8(d) of Revenue Regulations No. 5-87, the status of a zero-rated taxpayer (i.e. in so far as effective zero-rating is concerned) shall be valid only upon approval of an application.
