Vice President S i r s : This refers to your letter dated November 22, 1989, requesting that your corporation be exempt from the value-added tax (VAT) on the importation of Broiler Hatching Eggs and Day Old Chicks for breeding purposes. In reply, please be informed that pursuant to Sec. 103(b) of the Tax Code, as amended, the sale or importation in their original state of livestock and poultry of a kind generally used as, or yielding or producing food for human consumption, including breeding stock and genetic materials therefor, is exempt from the VAT. Since broiler hatching eggs and day old chicks are poultry products for breeding purposes, the importations thereof are exempt from the VAT. LLpr Very truly yours, JOSE U.
