February 15, 1990 VAT RULING NO. 043-90 Capilitan Engineering Corporation 210 Zaragoza Street Tondo, Manila Attention: Mr . Franco P . Capilitan Manager Gentlemen : This refers to your letter of July 21, 1989 requesting exemption from the payment of Value-Added Tax on your receipts derived from your marine repair services rendered to shipping companies. In reply thereto, please be informed that your request cannot be granted for lack of legal basis. Services rendered to shipping companies which are subject to 3% common carrier's tax under Sec. 115 of the Tax Code, as amended are not among those exempt from the value-added tax prescribed in Section 103 of the same Code.
