May 29, 2001 VAT RULING NO. 033-01 109 (D) Philippine Phosphate Fertilizer Corporation 10th Floor Pearlbank Centre 146 Valero Street Salcedo Village, Makati City Attention: Mr . Albert R . Sunga Risk & Tax Manager Gentlemen : This refers to your letter dated April 24, 2001 requesting for a certificate of exemption from the value-added tax under Section 103(d) of the National Internal Revenue Code (NIRC) of 1977 [now Section 109(d) Tax Code of 1997], being a corporation engaged in the sale of fertilizers. In support of your request, you submitted copies of your 1997 and current licenses issued by the Fertilizer and Pesticide Authority pursuant to Presidential Decree No. 1144. In reply, please be informed that as a duly licensed manufacturer, importer, distributor and exporter of fertilizers, you are exempt from VAT pursuant to Section 103(d) of the NIRC of 1977 [now Section 109(d) of the Tax Code of 1997]. This ruling is being issued on the basis of the foregoing facts as represented.
