January 8, 1992 VAT RULING NO. 003-92 Erma Industries, Inc. 115 North Bay Boulevard Navotas, Metro Manila Attention: Mr. Sergio Ortiz Luis, Jr. Vice-President Gentlemen : This refers to your letter dated November 22, 1990 requesting information as to whether or not your sale of marine food products (prawns) in their original state is exempt from VAT. In reply, please be informed that since the papers you presented show that your VAT registration covers only the activity of selling goods other than the marine products, your sale of the said marine products, whether domestic or export, remains exempt from value added tax pursuant to Sec. 103(b) of the Tax Code.
