SERRANO WHEREAS , Republic Act No. 7160, otherwise known as the Local Government Code, empowers each local government unit to create its own sources of revenue and to levy taxes, fees and charges subject to the provisions of the same and consistent with the basic policy of local autonomy; HTcADC WHEREAS , Section 305 (c) of the Local Government Code provides that local revenue shall be generated only from sources expressly authorized by law or ordinance; WHEREAS , pursuant to the aforementioned power to tax, on 07 December 1992, the Sangguniang Panlungsod of Valenzuela enacted Ordinance No. 92-102, also known as the Revenue Code of the Municipality (now City) of Valenzuela, Book I; WHEREAS , under Section 18 of the said Ordinance as amended by Ordinance NO. 237, Series of 2015, "An Ordinance amending Section 18 of 92-012, Series of 1992, otherwise known as "The Revenue Code of the Municipality (Now City) of Valenzuela, Book I," the City of Valenzuela imposes "Ecological and Waste Management Charges" against every person (natural or juridical) engaged in business, professional or occupation within the City; WHEREAS ,under Section 19 of the said Ordinance, the city of Valenzuela imposes "Peace and Order Fund" against every person (natural or juridical) engaged in business, profession or occupation within the City. NOW, THEREFORE ,be it ORDAINED as it is hereby ORDAINED by the Sangguniang Panlungsod ng Valenzuela in session duly assembled the following: SECTION 1. Section 18 (7) of Tax Ordinance No. 92-012, Series of 1992, as amended, is hereby amended to read as follows: "Section 18. Ecological and Waste Management Charges. xxx xxx xxx 7.05. Residential Apartment, per door ...Php10.00" SECTION 2. Section 19 (7) of Tax Ordinance No. 92-012, Series of 1992, is hereby amended to read as follows: "Section 19. Peace and Order Fund . xxx xxx xxx 7.05. Residential Apartment, per door ...Php10.00" SECTION 3. Repealing Clause . Any ordinance or part or provisions thereof which are inconsistent with any of the provision of this Ordinance herewith are hereby repealed or modified accordingly. SECTION 4. Separability Clause . If any part, section or provision of this Ordinance is declared invalid or contrary to existing Civil Service rules and pertinent laws, the parts, section or provision not affected thereby shall continue to be in force and effect.
