February 25, 2013 VALENZUELA CITY ORDINANCE NO. 075-13 AN ORDINANCE PROVIDING FOR AUTHORIZATION AND RECOGNITION OF THE USE OF AUTOMATED SYSTEM OF PAYMENT TRANSACTIONS OF TAXES, FEES AND OTHER PAYMENTS TO THE CITY OF VALENZUELA Authored by: Councilor Marlon Paulo C. WHEREAS, Section 24, Article II of the 1987 Philippine Constitution clearly emphasizes that the State shall recognize the vital rote of communication and information in nation-building; WHEREAS, Section 16 of the Republic Act No. 7160, commonly known as the General Welfare Clause of the Local Government Code of the Philippines, highlights the encouragement and support of the development of appropriate and self-reliant scientific and technological capabilities, enhancement of economic prosperity, maintenance of peace and order and preservation of comfort and convenience of the people; WHEREAS, Section 2, Part I of the Republic Act No. 8792 otherwise known as the "Electronic Commerce Act of 2000" emphasizes the need to create an information-friendly environment which supports and ensures the availability, diversity and affordability of Information Communication Technology (ICT) products and services; TSHIDa WHEREAS, Electronic Payment and Collection System (EPCS) should be able to accommodate various modes and channels of electronic payment pursuant to Joint Department Administrative Order No. 02, Series of 2006 of Department of Trade and Industry and Department of Finance provided for Guidelines Implementing R.A. No. 8792 on Electronic Payment and Collection System (EPCS) in Government; WHEREAS, use of access devices for payment of fees, charges, assessments and revenue due to the government through the Government Entity's EPCS is hereby authorized to bring about a more efficient and effective payment and collection service for government transactions and to provide the transacting clients additional payment options for transactions with government pursuant to Joint Department Administrative Order No. 10-01, Series of 2010; WHEREAS, the Monetary Board in its Resolution No. 324 dated 26 February 2009, approved the following guidelines governing the issuance of electronic money (e-money) and the operations of electronic money issuers (EMI) in the Philippines; WHEREAS, it is the policy of Bangko Sentral ng Pilipinas (BSP) to foster the development of efficient and convenient retail payment and fund transfer mechanism in the Philippines pursuant to Circular No. 649, Series of 2009 issued by the Office of the Governor of Bangko Sentral ng Pilipinas; WHEREAS, in furtherance of our Valenzuela City's Investment and Incentives there is a need to endeavor more investment by providing an enabling environment that will generate and enhance economic activities within the area; WHEREAS, pursuant to our 3S (Simple, Speed, Service) in Public Service Program there is a need to continuously formulate a program and initiatives that are efficient, accessible and easy to implement, to make certain all business process in the City go as smoothly as possible; WHEREAS, automating the system of payment transactions of taxes, fees and other payments to the City of Valenzuela is in furtherance of our goal in instituting good governance reforms that would increase transparency in government transactions and make our business processes more efficient and convenient for our constituents or taxpayers whom we consider our valued customers; WHEREAS, an efficient and effective collection of taxes is a pre-requisite to generate the necessary income for the City that will support infrastructure projects and delivery of basic services; cESDCa NOW THEREFORE, be it ORDAINED as it is hereby ORDAINED by the City Council of Valenzuela in session duly assembled: SECTION 1. Title . This Ordinance shall be known as Automated Payment Tax System of Valenzuela City. SECTION 2. Findings Incorporated. The findings and laws above are hereby incorporated and made integral part of this ordinance. SECTION 3. Declaration of Policy. The City recognizes the move for Electronic Governance (EGovernance) as a means of the City Government of Valenzuela to interact with our citizens (G2C), our private or business sectors (G2B) and also other government agencies/entities (G2G). Anchored on the principles of 3S (Simple, Speed and Service), Valenzuela City's Anti-Graft and Corruption Platform which guarantees Transparency and Good Governance that eliminates the possibility of graft and corruption with lesser personnel the taxpayer deal with. An electronic payment will enhance tax collection by ensuring that the necessary mechanism and procedures employed to encourage taxpayers to pay and settle their tax obligations. It is in the best interests of the public to adopt the automated payment of tax system as an alternative means for payment for taxes, fees and other payments collected by the City of Valenzuela. SECTION 4. Implementing Guidelines . Any implementing guidelines through Executive Order issued by the Local Chief Executive of Valenzuela for the enforcement of the provisions shall be prepared for the effective implementation of this Ordinance. SECTION 5. Separability Clause. If, for any reason, any part of this Ordinance is invalidated by a Court of competent jurisdiction, the remaining portion of the Ordinance shall remain in full force and effect. SECTION 6. Repealing Clause . All other laws, decrees, orders, issuances, rules and regulations which are inconsistent with the provision of this Ordinance are hereby repealed, amended or modified accordingly.
