Angoy Member Explanatory Note It is the recommendation of the Tagum City Investment Promotions Board to amend some provisions under the City Ordinance No. 661 or known as the Tagum City Local Investment Incentive Code of 2015 so as to make it aligned with both local and national policies and to make it more apparent to our investors the provisions of the local code; As per Presidential Decree 1096 or the National Building Code of the Philippines which provides for the mandatory imposition of fees of which the city engineer also designated as the official building officer through such code is also mandated to implement the same at the local level; That such amendment being regarded to harness the City Ordinance No. 661 or the Local Investment and Incentive Code of 2014 to make it more business-friendly while, at the same time, considering the economic benefit that the local government can get from it both fiscal and non-fiscal, while also protecting the various implementing agencies from non-implementation of certain laws; TAGUM CITY ORDINANCE NO. 721-15 AN ORDINANCE AMENDING CHAPTER 6 SECTION 18 (C), CHAPTER 7 SECTION 23 (A), (A-NO. 3), CHAPTER 7 SECTION 24 (A), CHAPTER 7 SECTION 25 (A) OF THE CITY ORDINANCE NO. 661, S-2014 "AN ORDINANCE ENACTING THE TAGUM CITY INVESTMENT INCENTIVE CODE" BE IT ENACTED by the Sangguniang Panglungsod of Tagum in Session Assembled, that: SECTION 1. CHAPTER 6 sec. 18 (C) of City Ordinance No. 661, s-2014, "An ordinance enacting the Tagum City Investment Incentive Code" which read as follows, . . . 1. . . . 2. . . . 3. Expansion shall undertake any of the following activities such as the construction of new buildings, installation of new machineries and equipment, or improvement thereof which will result to at least 25% increase in production of the same product for expanding enterprise, and production of another product line of the same enterprise for diversion. EcTCAD Is hereby amended to read as follows : 1. . . . 2. . . . 3. Expansion shall undertake any of the following activities such as the construction of new building, installation of new machineries and equipment, or improvement thereof which will result to at least 25% projected increase in production or sales of the same products or services expanding enterprise, and production of another product of the same enterprise for diversion. SECTION 2. CHAPTER 7 sec. 23 A, A-NO. 3 which read as follows. . . . 1. Fiscal Incentive a registered enterprise qualified under this Code shall be exempted from payment of the Local Business Tax, Basic Property Tax and fees from building Permits, Mayor's permit and other fees except regulatory fees . 1. . . . 2. . . . 3. Exemption from Local Fees Charges exemption from the payment fees of Building Permit, Mayors permit, and licensing fees, for 1st year of operation only. The exemption should not extent to fees, for 1st year of operation only. The exemption should not extend to fees, sanitary inspection fees, electrical inspection fees and similar others, as well as rental for use of public utilities owned and operated by the local government. Is hereby amended to read as follows : 1. Fiscal Incentive a registered enterprise qualified under this Code shall be exempted from the payment of the Local Business Tax, Basic Property Tax and fees from Mayor's permit on Zonal and Locational Clearance except regulatory fees . 1. . . . 2. . . . 3. Exemption from Local Fees Charges exemption from the payment of Mayor's Permit on Zonal and Locational Clearance for 1st year of operation only. The exemption should not extend to fees charges imposed for service rendered by the LGU, such as garbage fees, sanitary inspection fees, electrical inspection fees and other regulatory fees , as well as rental for use of public utilities owned and operated by the local government. SECTION 3. CHAPTER 7 sec. 24 (a) which read as follows. . . . 1. Exemption from the payment of fees from Building Permit, Mayor's Permit and Licensing fees and charges for the 1st year of Operation, except for Regulatory fees; Is hereby amended as follows : 1. Exemption from the payment of fees from Mayor's Permit on Zonal and Locational Clearance for the 1st year of operation, except for regulatory fees; SECTION 4. CHAPTER 7 sec. 25 (a) which read as follows. . . . 1. Exemption from the payment of fees from Building Permit, Mayors Permit and other fees and charges for the 1st Year of operation, except for Regulatory Fees. Is hereby amended to read as follows : 1. Exemption from the payment of fees from Mayors Permit on Zonal and Locational Clearance for the 1st year of operation, except for regulatory fees; SECTION 5. Effective Clause . This ordinance shall take effect immediately upon its approval and shall continue to be in full force and effect unless otherwise totally repealed by the Sangguniang Panlungsod of Tagum City.
