Fermo SP Member (ABC) Absent: None RESOLUTION NO. 062-6TH SP RESOLUTION ENACTING ORDINANCE NO. 04, SERIES OF 2015 ENTITLED, "AN ORDINANCE AMENDING RESOLUTION NO. 149, EMBODYING ORDINANCE NO. 06, SERIES OF 2014 ENTITLED, "AN ORDINANCE ADOPTING THE SCHEDULE OF FAIR MARKET VALUES FOR THE 2014 GENERAL REVISION OF REAL PROPERTY OF THE CITY OF TACURONG USING THE 2011 SCHEDULE OF FAIR MARKET VALUES" BY COLLECTING TWENTY-FIVE PERCENT (25%) ONLY OF THE INCREASE OF THE TAX DUE IN ADDITION TO THE CURRENT REAL PROPERTY TAX FOR RESIDENTIAL LOTS, RESIDENTIAL SUBDIVISIONS AND INDUSTRIAL LOTS ONLY, AND CREDITING THE EXCESS PAYMENTS OF THOSE TAX PAYERS WHO HAVE EARLIER PAID TO THE SUCCEEDING TAXABLE YEARS" Presented by Honorable Flores to the body for appropriate action was the need to amend Ordinance No. 06, series of 2014 entitled, "An Ordinance Adopting the Schedule of Fair Market Values for the 2014 General Revision of Real Property of the City of Tacurong Using the 2011 Schedule of Fair Market Values", by Collecting Twenty-Five Percent (25%) only of the Increase of the Tax Due in Addition to the Current Real Property Tax for Residential Lots, Residential Subdivisions and Industrial Lots Only and Crediting the Excess Payments of those Tax Payers who have earlier paid to the succeeding Taxable Years; WHEREAS, the August Body, through oversight approved an increase of four hundred percent (400%)-five hundred percent (500%) in the Schedule of Fair Market Values under Ordinance No. 06, series of 2014, entitled "An Ordinance Adopting the Schedule of Fair Market Values for the 2014 General Revision of Real Property of the City of Tacurong Using the 2011 Schedule of Fair Market Values; WHEREAS, the intention of the Members of the Sangguniang Panlungsod is that the increase in the latest Schedule of Fair Market Values should be minimal; WHEREAS, Section 214 of R.A. 7160 or the Local Government Code of 1991 states: "Amendment of Schedule of Fair Market Values The Provincial, City or Municipal Assessor may recommend to the Sanggunian concerned amendments to correct errors in valuation in the Schedule of Fair Market Values. The Sanggunian concerned shall, by Ordinance, act upon the recommendation within ninety (90) days from receipt hereof." WHEREAS, the excess payments of those tax payers who have earlier paid shall be credited to the succeeding taxable years; WHEREFORE, after due deliberation and upon motion of Honorable Flores which was jointly seconded by all the members of the council present, it was RESOLVED, as it is hereby resolved, to enact the following Ordinance to wit: TACURONG CITY ORDINANCE NO. 04-15 AN ORDINANCE AMENDING RESOLUTION NO. 149, EMBODYING ORDINANCE NO. 06, SERIES OF 2014 ENTITLED, "AN ORDINANCE ADOPTING THE SCHEDULE OF FAIR MARKET VALUES FOR THE 2014 GENERAL REVISION OF REAL PROPERTY OF THE CITY OF TACURONG USING THE 2011 SCHEDULE OF FAIR MARKET VALUES" BY COLLECTING TWENTY-FIVE PERCENT (25%) ONLY OF THE INCREASE OF THE TAX DUE IN ADDITION TO THE CURRENT REAL PROPERTY TAX FOR RESIDENTIAL LOTS, RESIDENTIAL SUBDIVISIONS AND INDUSTRIAL LOTS ONLY, AND CREDITING THE EXCESS PAYMENTS OF THOSE TAX PAYERS WHO HAVE EARLIER PAID TO THE SUCCEEDING TAXABLE YEARS" Be it Ordained by the Sangguniang Panlungsod of Tacurong in its Regular Session assembled, that: SECTION 1. Title. This Ordinance shall be known as "An Ordinance Amending Ordinance No. 06, series of 2014 entitled, "An Ordinance Adopting the Schedule of Fair Market Values for the 2014 General Revision of Real Property of the City of Tacurong Using the 2011 Schedule of Fair Market Values" by Collecting Twenty-Five Percent (25%) only of the Increase of the Tax Due in Addition to the Current Real Property Tax for Residential Lots, Residential Subdivisions and Industrial Lots Only, and Crediting the Excess Payments of those Tax Payers who have Earlier Paid to the Succeeding Taxable Years." aDSIHc SECTION 2. Separability Clause . If for any reason, any provision of this Ordinance is declared to be unconstitutional by a court of competent jurisdiction, the remaining provision not affected shall remain to be in full force and effect. SECTION 3. Repealing Clause. This Ordinance shall supersede, amend and or modify any ordinances, resolutions or executive orders deemed hereof. SECTION 4. Effectivity Clause . This ordinance shall take effect ten (10) days following its publication in a newspaper of local circulation in the City of Tacurong.
