Evangelista AN ORDINANCE IMPOSING FEES AS FIXED HEREIN ON THE FINISHED PRODUCTS FOR SALE OUT OF THE WASTE MATERIALS AND ON THE PULVERIZED RESIDUAL WASTES AT THE MUNICIPAL ECOLOGICAL PARK AND ECOLOGY CENTER (MEPEC) OF STO. TOMAS, DAVAO DEL NORTE BE IT ENACTED BY THE SANGGUNIANG BAYAN OF STO. TOMAS, DAVAO DEL NORTE, in a regular session assembled, that: SECTION 1. Definition of Terms . Ecological Park refers to the garbage dumping site controlled by the Local Government Unit (LGU) of Sto. Tomas and developed into a tree park and garden; STHDAc Ecological Center refers to the systematically managed dumping site of the Local Government Unit (LGU) of Sto. Tomas where the indigenous processing of decomposed biodegradable wastes are produced into quality compost fertilizers and quality concrete products; Concrete Products refers to the finished products processed out of the decomposed biodegradable wastes mixed with sand, cement, and pulverized residual wastes at the ecological center such as paving blocks (fish scale), paving blocks (zigzag designs), hollow blocks (6" and 4") tiles, and balusters; Pulverized Residual Wastes are processed residual wastes used in the manufacture of hollow blocks, balusters and the like. SECTION 2. Imposition of Fee . There shall be imposed fees for the selling of concrete products at the Municipal Ecological Park and Ecology Center (MEPEC) as follows: A. Concrete Hallow Blocks (4") 6.50 5. Titles 9.00 6. Balusters 55.00 B. Pulverized Residual Wastes P10.00/kilo SECTION 3. Administrative Provisions. The sale of the concrete products and pulverized residual wastes at the MEPEC shall be in the following steps: SaCIAE 3.1. There shall be filled-up an order or request forms to ensure availability of the items to be certified by the duly authorized personnel in-charge of the Municipal Ecological Park and Ecology Center products; 3.2. Upon certification of the availability of the items, payments shall be made to the Municipal Treasurer or to her duly authorized personnel and an official receipts shall be issued for the purpose; 3.3. The official receipts shall be presented to the authorized personnel at the MEPEC for control and release of the items purchased; 3.4. All released items shall be considered sold. Payments out of the sale of the ESWM materials shall be recorded in a separate account under the ESWM funds for proper accounting and control and to facilitate smooth inventory. SECTION 4. Manufactured items in the MEPEC shall have proper inventory record with the accounting office and shall be accounted every week. SECTION 5. Responsibilities in the disposition of goods and its inventory shall rest upon the Senior Environmental Management Specialist as the supervision of the MEPEC; SECTION 6. Penalty Clause . Any unauthorized releases of articles or items at the MEPEC shall be penalized as follows: a) For the person receiving the articles shall be penalized in the amount of Five Thousand Pesos (P5,000.00) or an imprisonment of not more than thirty (30) days at the discretion of the court; b) Local Government Unit (LGU) personnel involved termination for employment. SECTION 7. Effectivity . This ordinance shall take effect immediately upon compliance of the requirements of law and fifteen (15) days after its publication in any newspaper of national circulation.
