[SEC-SICD * ORDER NO. 104. July 27, 1982.] IN THE MATTER OF ALL MEMBER-FIRMS OF THE OPERATING STOCK EXCHANGES REPORT ON INVENTORY OF STOCK CERTIFICATES O R D E R In the interest of the investing public, and in order to facilitate monitoring of the movements of customer's securities under the control of stock broker-members of the stock exchanges, this Commission, pursuant to the powers vested in it under existing laws and conformably with existing rules, hereby amends SEC Order No. 107 dated September 18, 1981, to read as follows: LexLib 1. All member-firms operating stock exchanges shall submit quarterly to the Commission an inventory of all securities/stock certificates under their control. 2. In order to have a uniform report, the following rules and format shall be strictly followed and complied with. 2.2 On quarters where audited semi-annual or annual financial statements are due, the inventory shall also be audited and submitted together with the semi-annual financial statements. (Within 60 days following end of the period under report). 2.3 On quarters which do not coincide with the submission of the semi-annual and annual financial statements, a report on active or moving securities and new or additional securities acquired shall be submitted within thirty (30) days following the end of the quarter, certified under oath by the President/General Manager or the Treasurer of the brokerage firm . 2.4 For active or moving securities, the same format shall be followed, except Columns "10" and "11" thereof which shall be denominated as follows and contain the following information: "10" Date Out For certificates included in previous report but were delivered to the customers, clearing house or transfer office during the quarter. "11" To Whom Delivered". 4. New member-broker who will be submitting the report for the first time shall submit an inventory of all securities/stock certificates following: 2.1 format, certified under oath by its President/General Manager or the Treasurer. 5. Any violation of the provisions of the foregoing Order shall be penalized as follows: a. First Violation Not more than P200.00 per day of delay b. Second Violation Suspension of (5) trading days. c.
