[SEC-SICD * CASE NO. 3916. January 3, 1995.] SUPREMA T. DUMO , petitioner , vs . LEONG KIM CHYE, ET AL. , respondents . O R D E R Records of this office show that the instant case has been set for (4) consecutive hearings and in all these four settings, petitioner and her counsel failed to appear, showing as it does the lack of interest on the part of petitioner to pursue the prosecution of the instant case. Considering that this case has been pending for quite a reasonable period of time and the delay apparently was always due to petitioner and her counsel's failure to appear during the scheduled hearing, this Hearing Officers has no other alternative but to consider petitioner to have lost interest in further proceeding with the prosecution of the complaint. WHEREFORE, the instant case should be as it hereby DISMISSED for failure to prosecute. LLpr SO ORDERED (SGD.) ALBERTO P. ATAS Hearing Officer
