[SEC-SICD * CASE NO. 3911. February 4, 1992.] EDGARDO P. SAGAIDORO, ET AL. , plaintiffs , vs . MOISES C. CANAYON, ET AL. , defendants . PARTIAL JUDGMENT BY COMPROMISE AGREEMENT The parties, plaintiffs Edgardo P. Sagaidoro and Leticia C. Sagaidoro and defendants Moises C. Canayon, Norma G. Canayon and Elisa B. Vinson, in the above-entitled case, assisted by their respective counsels, submitted a Compromise Agreement dated January 23, 1992 the terms and conditions of which reads as follows: "1. That defendants MOISES C. CANAYON, NORMA G. CANAYON, and ELISA B. VINSON agree to pay to plaintiffs the amount of P1,000.00 per head of their respective deployed workers, as per records of the corporation, for the period January 1, 1990 to December 31, 1991; 2. That said defendants shall pay all their respective overdue obligations with the corporation, as appearing in the records of the corporation, such as: a) Advances; b) Share in rentals; and c) others. 3. That defendants shall share in the payment of the BIR Income Tax, pro-rated to their deployment; 4. That defendants shall shoulder any liability that may arise from claims of their respective deployed persons, which are now pending with the POEA or may be filed by complaining deployed persons for the period January, 1990 to the present; 5. That defendants shall return to plaintiffs all their respective shares of stocks in the corporation, and all henceforth have no participation anymore as shareholders in the corporation; defendants likewise agree that they are forever barred from acquiring any shares in the Manila Manpower Services Corporation from any source whatsoever; 6. That defendants shall surrender all corporate books, papers, vouchers, official receipts, and other corporate documents which are in their possession; 7. That plaintiffs and defendants agree to drop/dismiss all criminal cases pending before them, including the case against Ferdinand Sagaidoro and Susan Aganon; 8. That parties agree that they shall no longer file any cases whatsoever against each other in so far as their relations and participation in the management of Manila Manpower Services Corporation is concerned; 9. That this compromise agreement shall be the basis of the PARTIAL DECISION in this case between plaintiffs and defendants MOISES C. CANAYON, NORMA G. CANAYON, and ELISA B. VINSON only , and plaintiffs shall proceed with the case against the other 3 defendants, TEO CHONG BENG, TAN BON KIAT, and VANGIE DEL ROSARIO." Finding the foregoing Compromise Agreement not contrary to law, morals and public policy, the same is hereby APPROVED and judgment is hereby rendered in accordance therewith.
