[SEC-SICD * CASE NO. 3461. March 10, 1989.] VICENTE T. FLORES , petitioner , vs . SOUTHERN RIZAL INSTITUTE ET AL. , respondents . PARTIAL DECISION At the pre-trial hearing held on March 3, 1989, the parties, after a short argument, agreed to settle the case in so far as the issues concerning petitioner's payment of the unpaid subscription and interest charges are concerned. The parties having agreed on the amount to be paid by petitioner, petitioner tendered to this Commission the amount of SEVENTY FOUR THOUSAND FOUR HUNDRED PESOS (P74,400.00) representing payment of his unpaid subscription in the corporation. The Commission, in turn, gave said amount to the Treasurer, Mrs. Anita L. Ausmolo, who willingly accepted the payment and issued a receipt for said amount dated March 3, 1989. llcd Petitioner having paid for all his unpaid subscription, which payment was duly received and receipted by respondent Anita L. Ausmolo, let this case, in so far as the issues on payment of unpaid subscription and interest charges are concerned, be DISMISSED, for having been rendered moot and academic. SO ORDERED. (SGD.)
