[SEC-SICD * CASE NO. 2490. December 27, 1994.] VICMAR DEVELOPMENT CORPORATION , petitioner , vs . RUFINO T. NASSER , respondent . O R D E R Acting upon the respondent's Manifestation and Motion To Dismiss dated November 8, 1994, and it appearing as manifested therein that an Escrow Agreement was entered into between respondent Rufino Nasser and Peter Angliongto, as Administrator of the estate of Vicente Angliongto and the Far East Bank and Trust Company (FEBTC), as the escrow agent and pursuant to its provisions, the amount of Eleven Million (P11,000,000.00) Pesos was deposited in escrow with the FEBTC for the benefit of the parties with the condition that the said amount will be released by the said bank to Peter Angliongto upon presentation of a final order dismissing all the pending Criminal Cases (for violation of B.P. 22) filed by petitioner Vicente Angliongto against respondent Rufino Nasser; and it appearing further that all the aforesaid criminal cases have already been DISMISSED by the Makati Regional Trial Court on January 6, 1994 and the amount of Eleven Million (P11,000,000.00) Pesos have been released to Peter Angliongto, as evidence by Annex "A" of the Supplemental Motion to Dismiss dated Dec. 9, 1994, and finding no more need or reason to conduct further proceedings thereon, let the instant case be, as it is hereby, DISMISSED with prejudice. dctai SO ORDERED.
