[SEC-SICD * CASE NO. 12-99-6475. February 28, 2000.] RENATO DE VEGA, ET AL. , complainants , vs . OFFICERS OF COLOONG OPERATORS AND TRICYCLE DRIVERS ASSOCIATION, INC., HEREIN REPRESENTED BY REY DE JESUS, ET AL. , respondents . JUDGMENT ON COMPROMISE AGREEMENT For consideration before the Commission is a Compromise Agreement, dated 21 February 2000, which was subscribed to by the parties and their counsels before the undersigned Hearing Officer during the hearing of the above-entitled case on 24 February 2000, the terms and conditions of which are hereby restated as follows: "1. That herein contending parties mutually agreed to settle their differences amicably and bind themselves to observe and follow faithfully their association's by-laws, rules and regulations to promote camaraderie harmony among its officers and members; SHAcID 2. That upon the signing hereof, the respondents undertake to open the books of accounts of the association for verification and inspection of its members and if no such books of accounts available then immediately to provide a new set of books of accounts for accounting of funds that will show all the collections supported by official receipts and disbursements evidenced by vouchers/checks signed by the treasurer and countersigned by the president, conduct monthly and annual meetings to render report to the members regarding the operations, activities and funds of the association and to observe the term limit of officers to one (1) year unless re-elected and qualified to be determined in an election to be held for the purpose, whereas, the complainants undertake to comply with their obligations to update their accounts and pay regular their membership dues, attend monthly and annual meetings, participate in the election of officers and follow faithfully the association's rules and regulations; 3. That failure of either of the contending parties to comply with their respective above undertakings shall be governed strictly by the association's by-laws and rules and regulations, and shall be reported directly to the Honorable Commission for enforcement of this compromise agreement and imposition of applicable penalties against the erring party." It appearing that the aforequoted Compromise Agreement is not contrary to law, public order, public policy, morals and good custom, the same is hereby APPROVED. IcCDAS Accordingly, judgment is hereby rendered in accordance with the said Compromise Agreement and the parties in the above-entitled case are thus enjoined to strictly comply with and implement the terms and conditions set forth in therein.
