[SEC-SICD * CASE NO. 12-94-4939. February 16, 1995.] ALEXANDER A. PADILLA, ET AL. , petitioners , vs . BOARD OF DIRECTORS OF THE MANILA JAYCEES, ET AL. , respondents . O R D E R In the hearing of February 15, 1995, which date the preliminary conference of the above entitled case has been set, Atty. Rommel A. Frias, counsel for the respondents appeared and presented a Special Power of Attorney executed by his clients authorizing him to represent the latter during the preliminary conference and in entering into a compromise agreement. There was no representation for the petitioners, whereupon counsel for the respondents moved in open court that petitioners be declared non-suited and this case be dismissed. If appearing that petitioners failed to file their preliminary conference brief and did not appear on the scheduled preliminary conference despite due police petitioners are hereby declared non-suited in accordance with Section A of Rule VIII of the REVISED RULES OF PROCEDURE IN THE SECURITIES AND EXCHANGE COMMISSION, AS AMENDED .
