March 31, 2003 SEC OPINION NO. 14-03 Mr. Anacleto A. Lagdameo President CAMARINES NORTE GOVERNMENT RETIREES ASSOCIATION, INC. Daet, Camarines Norte S i r : This refers to your letter dated 24 January 2003 requesting the opinion of the Commission as to the legality of the withdrawal of one of the chapter members of the subject-association considering that the by-laws thereof does not contain any provision regarding the same. Relative thereto, please be advised that the constitutional guarantee as to freedom of association (Article III, Section 8, 1987 Philippine Constitution) covers the right not to join an association. ( Bernas, The 1987 Philippine Cons titu tion, A Reviewer-Primer ) Corollary to such right is the right to disassociate from an organization.
