Makati, Metro Manila Gentlemen: This is in reply to your letter dated August 21, 1981, requesting pre-approval of your intention to change the corporate name of The Edward J. Nell Co. to Jardine Nell Engineering Corporation. Please be informed that under R.A. 544 as amended by R.A. 1582, the word "Engineering" is prohibited to be used as part of the corporate name of a corporation. This is to avoid the possibility of misleading the public to believe that the corporation is engaged in the practice of engineering profession which is categorically prohibited under Section 24 of said Act. Although subject corporation is duly licensed as contractor in general engineering by the Philippine Licensing Board for contractors, the same cannot be implied to have been authorized to engage in the practice of engineering as the business referred to in the license refers to that of contracting business not on the practice of engineering. Be advised further that a verification made on the corporate records on file in this Office disclosed that said corporation is not authorized under its articles of incorporation to do contracting business.
