Cesar Aguilar Counsel Fortune Tobacco Corporation Parang, Marikina Metro Manila S ir : In connection with your letter-query of March 1, 1982 requesting opinion if this Commission has the original and exclusive jurisdiction to investigate and/or hear and decide a criminal case for estafa, defined and penalized by Art. 315, No. 2(b) of the Revised Penal Code, please be advised that as a rule, this Commission refrains from rendering opinion on justiciable issues. However, for purposes of general information only, we hereby inform you that under P.D. Nos. 902-A, 1653, 1758 and 1799, this Commission has no jurisdiction to investigate, hear and decide a criminal case for estafa defined in Art. 315, No. 2(b) of the Revised Penal Code. llcd Please be guided accordingly.
