July 29, 1982 Atty. Sofronio C. Untalan, Jr. Corporate Secretary, PAGKA Inc. P.O. Box 259 Makati, Commercial Center Makati, Rizal Sir : This refers to your letter dated July 27, 1982, requesting exemption from the coverage of SEC opinion dated April 1, 1981 and addressed to Director E.B. Castillejos of the Bureau of Domestic Trade, prescribing that a corporation desiring to adopt a business name or style other that its corporate name is required to state the business name or style in the articles of incorporation of said corporation. It appears in your letter that your reason for requesting such exemption is that it will be very cumbersome to amend the articles of incorporation everytime you put up a branch store. You have further alleged that this request for exemption is not made in order to evade liability out of the operation of said branch. Please be informed that the Commission has granted a similar request in its letter of September 9, 1981 and addressed to Atty. Filipina A. Gatmaytan of 106 Paseo de Roxas, Makati, Metro Manila.
