June 5, 2002 SEC OPINION Atty. Victor A. Africa Corporate Secretary One Lafayette Condominium Association Inc. 132 L.P. Leviste St. Salcedo Village, Makati City Dear Atty Africa, This pertains to your letter dated April 16, 2002 requesting opinion on the determination of the membership of the association with concomitant right to vote. This question arose when the status of recognized members were raised in a civil suit filed by registered unit owners of the condominium project. Hence, this query seeking confirmation as to who between the purchasers and the registered owners should be recognized as members of the condominium project. The Condominium deems it best to refrain from ruling on the issue posed in this query considering the pendency of the civil case before the regular courts involving the same subject. In deference to the Court, you are hereby advised to await the decision of the court on the matter. Very truly yours, (SGD.) BENITO A. CATARAN Director Company Registration and Monitoring Department
