August 9, 2002 SEC OPINION Atty. Fe L. Concepcion Tan & Concepcion Law Firm Suites 2104-2106, 21st Floor, Medical Plaza, Ortigas Center Pasig City 1661 Dear Atty. Concepcion, This refers to your letter dated July 19, 2002 requesting confirmation of your opinion on the Retail Trade Liberalization Act of 2000 (R.A. 8762). The exception under Section 3(1)(d) of the Retail Trade Liberalization Act and Section 2(d) of its Implementing Rules and Regulations covers sales to the general public, through a single outlet owned by the manufacturer of products manufactured, processed or assembled in the Philippines, irrespective of its capitalization. The sale contemplated by your client corporation in its Makati showroom, its sole outlet, clearly falls under the abovementioned exception. Very truly yours, (SGD.) JESUS E.G. MARTINEZ Commissioner
